These Terms and Conditions ("Terms") govern your access to and use of the Sequack Outpost web‑based DMARC management platform, including any related mobile applications, browser extensions, APIs, and associated services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
1. Definitions
Account: The user credential(s) enabling access to the Service.
Customer Data: All DNS records, DMARC reports, emails, domain names, and other data submitted to the Service by you or on your behalf.
Subscription: The paid or free plan under which the Service is provided.
Sequack, we, us, or our: The entity providing the Service, as identified in Section 15.
2. Eligibility & Account Registration
You must be at least 18 years old and legally able to enter into contracts.
When you create an Account, you must provide accurate, complete, and up‑to‑date information.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
We may suspend or terminate your Account if we reasonably believe you have violated these Terms.
3. The Service
The Service helps you generate, publish, monitor, and analyze DMARC, SPF, DKIM, BIMI, and related email‑authentication records.
The Service may query third‑party DNS servers, receive aggregate and forensic DMARC reports, send email alerts, and display analytics dashboards.
We continually improve the Service and may add, modify, or remove features at any time.
We do not guarantee 100% availability but will use commercially reasonable efforts to minimize downtime.
4. Subscriptions, Trials & Payments
Plans & Fees. Pricing, billing cycles, and feature limits are described on the Site or Order Form.
Trials. If you register for a free trial, the trial period will terminate on the earlier of (a) the last day of the stated trial period or (b) the start of a paid Subscription.
Automatic Renewal. Unless you cancel before the end of the current term, your Subscription will automatically renew, and you authorize us to charge the then‑current fee using your payment method on file.
Taxes. Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable VAT, GST, sales, or use taxes.
Refunds. Except as required by law, all fees are non‑refundable.
5. Acceptable Use
You agree not to:
- Use the Service to violate any law, regulation, or intellectual‑property right.
- Interfere with or disrupt the Service or servers.
- Attempt to gain unauthorized access to other accounts or data.
- Reverse engineer, decompile, or disassemble the Service.
- Use the Service to transmit spam or malicious code.
6. Customer Data & Privacy
You retain all rights to Customer Data.
You grant us a worldwide, non‑exclusive, royalty‑free license to host, copy, process, transmit, and display Customer Data solely as necessary to provide the Service.
We will implement appropriate technical and organizational measures to protect Customer Data, as further described in our Privacy Policy and Data Processing Agreement (if applicable).
You represent that you have all necessary rights and consents to provide Customer Data to the Service.
7. Intellectual Property
The Service and all related intellectual‑property rights are and will remain the exclusive property of Sequack and its licensors.
Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your internal business purposes.
All trademarks, logos, and service marks displayed in connection with the Service are the property of their respective owners.
8. Third‑Party Services
The Service may integrate with or direct you to third‑party products or services (e.g., DNS providers, SIEM platforms). Your use of those third‑party services is governed solely by their terms. We are not responsible for any third‑party service.
9. Disclaimers
No Warranty. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
Email Deliverability. We do not guarantee that implementing DMARC via the Service will ensure email deliverability or prevent all phishing or spoofing attacks.
Data Accuracy. DNS responses, DMARC aggregate reports, and forensic data originate from third parties; we do not warrant their completeness or accuracy.
10. Limitation of Liability
To the maximum extent permitted by law, in no event will Sequack, its affiliates, directors, employees, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to the Service or these Terms, even if we have been advised of the possibility of such damages. Our total liability under these Terms will not exceed the fees you paid to us for the Service in the 12 months preceding the event giving rise to liability.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sequack and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your (a) use of the Service, (b) breach of these Terms, or (c) violation of applicable law.
12. Suspension & Termination
We may suspend or terminate your access to the Service immediately if you violate these Terms or if your payment is overdue.
You may terminate your Subscription at any time via your Account settings, but termination will not relieve you of your obligation to pay outstanding fees.
Upon termination, your right to use the Service will cease, and we may delete or deactivate your Account and Customer Data after a 30‑day retention period, unless legal obligations require longer retention.
13. Modifications to Terms
We may revise these Terms from time to time. We will post the updated Terms on the Site and update the "Last updated" date. Changes will take effect on the date indicated, but material changes will apply from the next renewal or Subscription purchase. Continued use of the Service after changes become effective constitutes acceptance.
